Texas vs. Biden: Supreme Court Weighs In on Emergency Abortion Care

In a surprising turn of events, the Supreme Court has declined to hear an appeal from the Biden administration in a legal tussle with Texas over emergency room abortion care. This decision leaves the lower court's ruling favoring Texas still standing. The case revolves around whether federal law on emergency medical treatment trumps state abortion restrictions. After the Supreme Court's 2022 reversal of Roe v. Wade, states like Idaho and Texas have imposed strict abortion bans, leading to legal battles. The federal law in question, passed in 1986, requires hospitals receiving Medicare funds to provide necessary emergency care, including to pregnant women with serious complications. Following the Supreme Court's decision on Roe v. Wade, the Biden administration issued guidance stating that states couldn't enforce parts of their abortion bans if they conflicted with this federal law. Texas challenged this guidance, and a lower court ruled against the administration.

The Supreme Court had previously avoided a major ruling on this issue in a similar case from Idaho. In Texas, after a district court judge sided with the state, the administration appealed to the Supreme Court but requested the justices to wait until they decided the Idaho case. The Solicitor General urged the court to reconsider the appeals court ruling over the summer. In another abortion-related development, the Supreme Court also declined to hear a case from Guam regarding its 1990 abortion ban. Additionally, the court didn't take up an appeal related to Alabama’s threat to in vitro fertilization availability, which was quickly addressed by state legislators.
