Qualcomm's Chip Off the Old Block: EU Court Chimes in with a Fine Tune

The European Union's General Court has been scrutinizing Qualcomm's antitrust practices, and the verdict is in: the tech giant's appeal to have a 242 million euro fine tossed out has been largely rejected. The fine, issued in 2019, was a result of allegations that Qualcomm engaged in "predatory pricing" to drive a competitor out of the market. The European Commission had accused Qualcomm of abusing its market dominance in 3G baseband chipsets by selling them below the cost of production. This move, the Commission claimed, was designed to force startup Icera out of the market a decade prior. Qualcomm's appeal centered around the Commission's calculation of the fine, which the company argued did not follow guidelines.

After a thorough examination of Qualcomm's arguments, the General Court decided to reject them all, except for the company's plea regarding the fine calculation. As a result, the fine has been trimmed to 238.7 million euros. Qualcomm has expressed its disagreement with the judgment and the Commission's decision, stating that it has always complied with European competition law. This verdict is a significant development in the ongoing saga between Qualcomm and the European Commission. The Commission had previously fined Qualcomm $1.23 billion for bribing Apple to stifle competition. However, the General Court overturned that decision in 2022 after Qualcomm appealed.
