The giveaway, which has already awarded $17 million, is set to end on Election Day. However, Philadelphia District Attorney Larry Krasner argued that the PAC's activities were a "scam" and an "illegal lottery. " He insists that Musk and his PAC know their actions are against the law. America PAC is backing Donald Trump in the presidential election against Kamala Harris. The PAC has been giving out money to people who sign a petition supporting the Constitution. Originally, Musk claimed the winners were chosen at random. But a recent testimony revealed that winners were selected based on their alignment with the PAC's values.

Chris Young, the PAC's treasurer, testified that recipients were questioned before winning to ensure their values matched those of the PAC. He also admitted that the term "randomly" used by Musk was not accurate. Chris Gober, the PAC's former treasurer, confirmed that the $1 million recipients were not chosen by chance. The judge's decision did not end the district attorney's lawsuit, which alleges violations of Pennsylvania lottery and consumer protection laws. Krasner believes his case has become stronger due to the PAC's admissions about the selection process.
