New DA Could Delay Retrial for Menendez Brothers

Nathan Hochman, the newly elected Los Angeles County District Attorney, might push for a delay in the resentencing of Erik and Lyle Menendez. The brothers were convicted of murdering their parents nearly three decades ago. Hochman wants to review the case thoroughly before making any decisions. This includes looking at prison records, trial transcripts, and consulting with involved parties. The hearing is set for December 11, just nine days after Hochman takes office. Hochman's predecessor, George Gascón, had asked for the brothers to be resentenced to life with parole, due to new evidence of abuse and their behavior in prison. This change would make them eligible for immediate parole under California law. Hochman believes in making a thorough decision quickly and fairly for all involved.

The Menendez brothers have another path to release apart from resentencing. Gascón also wrote letters supporting them for clemency, which could free them before Hochman's term starts. The case is back in the spotlight due to recent Netflix series and documentaries about the case. The brothers did not deny killing their parents but claimed it was self-defense against long-term abuse. Their first trial ended in a mistrial, and during the second, key defense evidence was excluded, leading to their conviction.
