McBurney's 26-page opinion emphasized the ban's infringement on women's fundamental rights to privacy and autonomy. He noted that many women might not even discover their pregnancies until after the six-week mark. Requiring women to carry an unwanted pregnancy to term imposed a form of involuntary servitude, disproportionately affecting low-income and minority women.

Georgia's reproductive healthcare system has been severely impacted by the ban's enforcement. Women were forced to seek access to unsafe or illegal abortions, putting their lives at risk. In recent weeks, two women in Georgia tragically lost their lives due to being unable to access legal abortions.
