In response, the Defense Department halted recruitment of new service members with gender dysphoria and paused gender-affirming care for transgender troops. The Pentagon even planned to remove transgender troops from service unless they obtained a waiver.
A group of transgender service members and those hoping to enlist sued, arguing that the ban is unconstitutional. They wanted a court order to block the policy. Reyes agreed with them, finding that the policy likely fails to meet the highest level of judicial scrutiny. She also found that the policy is driven by unconstitutional animus. Reyes believes the military can create a policy that balances the nation's needs and the rights of all Americans.
The decision is likely to be appealed, but it's another legal setback for the administration. Several of its policies have been temporarily blocked by federal judges. A second challenge to the military ban is also underway in Washington state. This is not the first time the administration has tried to bar transgender people from serving. A previous attempt was blocked by federal courts, and a revised plan took effect in 2019 but was later overturned.
