A Duck and a Fox: Musk and Ramaswamy's Plan to Simplify Regulations

Elon Musk and Vivek Ramaswamy, given their roles in President-elect Trump’s Department of Government Efficiency (DOGE), are gunning to scrap federal regulations. They point to Supreme Court rulings in 2022 and 2023 that limit agency regulatory power. However, legal experts believe these rulings could complicate their plans. They argue the rulings only add scrutiny to regulations, not abolish them. Overturning existing rules is a slow, resource-intensive process. Plus, Musk and Ramaswamy want to cut federal employees, the very people needed to review and change regulations.

Many of these experts also warn that DOGE’s plans could backfire. Important regulations might be delayed or even forgotten if not carefully handled. For example, during Trump’s first term, he slowed new regulations but had less success abolishing older ones. There is a simpler way to tackle newly implemented Biden-era rules. The Congressional Review Act lets senators reverse these rules without much resistance. These new rules, some 100 in total, might be eligible for reversal. Both Musk and Ramaswamy have personal stakes in this. Their business ventures could benefit from less regulation. Musk, in particular, has criticized government regulations for slowing down his companies’ progress.
